These Website Terms of Use ("Terms") govern your access to and use of https://bluehouraudio.us and any related pages we operate (the "Site"), which are provided by Blue Hour Audio LLC, trading as Blue Hour Audio ("we," "us," "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. These Terms and our other agreements

These Terms cover your use of the Site. Our software is licensed separately:

• Your use of our plug-ins (Blue Melody, Blue Drummer, Blue Slice, and the Blue Suite) is governed by our End User License Agreement (EULA).
• Purchases and renewals are governed by the EULA and our Refund Policy.
• How we handle personal data is described in our Privacy Policy and Cookie Policy.

If there is a conflict between these Terms and the EULA regarding the software itself, the EULA controls.

2. The Site and its content

The Site and everything on it — text, graphics, logos, images, audio, layout, and the names and marks "Blue Hour Audio," "Blue Melody," "Blue Drummer," "Blue Slice," and "Blue Suite" — are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to view and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, scrape, frame, mirror, or create derivative works from the Site or its content without our prior written permission, except as normal browser use allows.

3. Acceptable use

You agree not to:

• use the Site in violation of any applicable law, or for any unlawful or fraudulent purpose;
• interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or any connected systems;
• probe, scan, or test the vulnerability of the Site, or breach any security or authentication measures;
• use any bot, scraper, or automated means to access or collect data from the Site without our permission; or
• introduce malware or any harmful code, or use the Site to infringe anyone's rights.

4. Accounts

Some features (such as licensing or your subscription) may be managed through our payment and licensing provider rather than an account on the Site. Where you do create or hold credentials, you are responsible for keeping them secure and for activity under them, and you agree to notify us of any unauthorized use.

5. Purchases and checkout

Purchases are sold and processed by Lemon Squeezy (a Stripe company) acting as our merchant of record, or a successor provider we use. Prices, plans, and availability may change. All purchases are subject to the EULA and the Refund Policy, and to the payment provider's own checkout terms.

6. Third-party links and services

The Site may link to or embed third-party services (for example, the Lemon Squeezy checkout) and websites. We do not control and are not responsible for third-party content, products, or privacy practices. Your use of those services is governed by their terms.

7. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components. Nothing here excludes statutory rights that cannot be excluded by law.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. Our total liability relating to the Site (as distinct from the software, which the EULA governs) will not exceed USD 100. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

9. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Site or your breach of these Terms, except to the extent caused by us.

10. Governing law and disputes

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Before starting any proceeding, please contact us and give us at least 30 days to resolve the matter informally.

Any dispute relating to the Site or these Terms is subject to the same binding individual arbitration and class-action/jury-trial waiver set out in Section 13 of our EULA (administered by the AAA under its Consumer Arbitration Rules, seated in Oakland County, Michigan, with a 30-day opt-out, and carve-outs for small-claims and injunctive/IP relief). For any matter not subject to arbitration, the state courts located in Oakland County, Michigan and the U.S. District Court for the Eastern District of Michigan have exclusive jurisdiction. If you are a consumer, nothing here deprives you of mandatory protections or courts of your country of residence, and where local law prohibits pre-dispute arbitration or class waivers, they do not apply to you to that extent.

11. Changes

We may update the Site and these Terms from time to time. Changes take effect when posted, and the "Last updated" date will change. Your continued use of the Site means you accept the updated Terms.

13. General

If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, with the documents referenced in Section 1, are the entire agreement between us regarding the Site.
